The short answer
Both positions are common in the UAE and neither is hopeless. What most people get wrong is the starting point, because the rules changed with reforms that took effect in January 2022 and a lot of the advice still online describes how things worked before that.

What happens when a cheque is returned unpaid
The return slip
When a cheque is presented and there are not enough funds behind it, the bank returns it with a document recording the reason. That document is the starting point for everything that follows, so keep the original and do not hand your only copy to anyone.
Partial payment
Where there is some money in the account but not enough to cover the cheque, the bank may be required to pay out what is available and to record the shortfall. This changed the practical position for holders significantly, because a partly paid cheque leaves a documented balance.
What the reason for return means
Not every returned cheque is returned for lack of funds. A cheque can also come back because of a signature mismatch, a closed account, an instruction to stop payment, or a defect on the face of the instrument. The reason recorded matters, because the routes available afterwards are not the same.
If you issued the cheque
The first thing to establish is why it was returned, because that determines how serious your position is. Ignoring a returned cheque is the worst option available, since the holder has a route to enforcement that does not need your cooperation.
Talk to the holder before the file is opened if you can. A documented settlement or a payment schedule agreed early is normally cheaper than anything that follows. Do not issue a replacement cheque to buy time unless you are confident it will clear, because a second returned cheque makes the position worse rather than better.
If a file has already been opened against you, get the papers and find out what has actually been filed. People often assume a criminal case exists when what exists is an enforcement file, and the two require different responses.
If you are holding the cheque
You have a documented debt and an instrument that is designed to be enforced. That is a stronger starting position than an unpaid invoice.
Act promptly. Time limits apply to the routes available, and delay also gives the other side time to move money or leave the country. Gather the cheque, the return slip, the underlying contract or invoice, and any messages in which the debt is acknowledged.
What changed with the 2022 reforms
The shift away from automatic prosecution
Before the reforms, issuing a cheque that was returned for insufficient funds was routinely treated as a criminal matter. The reforms moved the ordinary case away from prosecution and towards enforcement and administrative consequences. In practice this means a returned cheque is now dealt with mainly as a debt to be recovered rather than as a crime to be punished.
What can still be treated as a criminal matter
The reforms did not remove the criminal element entirely. Conduct that goes beyond simply not having the funds, such as deliberately preventing a cheque from being paid or interfering with the instrument itself, is treated differently from an account that was short on the day.
Administrative penalties
Alongside the change in criminal treatment, a regime of administrative consequences applies to the person who issued the cheque. We do not publish the scale, the thresholds or any figures here, because they are set by regulation and an out of date number on a website causes real harm.
Cheques issued before the reform
Where the cheque predates the change, the treatment is not necessarily the same as for one issued afterwards. This comes up regularly with older security cheques.
The recovery route
Enforcement without a full lawsuit
The significant practical change for a holder is that a dishonoured cheque can be taken into enforcement directly, rather than requiring a substantive claim to be tried first and only then enforced. That shortens the route considerably.
What the court can order
Enforcement measures are aimed at securing payment from the debtor’s assets and at putting pressure on a debtor who can pay and will not.
When there is a wider dispute
A cheque given for a transaction that went wrong is not always a simple debt. Where the money was never owed, or the amount is disputed, or the cheque was given for something that was not delivered, that argument has to be raised properly rather than assumed to be obvious. If the other side has left the UAE
Departure does not extinguish the debt and does not close the file. What it changes is the practical route to recovery, which then depends on what the person left behind.
Security cheques
Why they are used
Undated or open cheques are widely taken as security in the UAE, by landlords, by lenders, by employers and in ordinary commercial contracts. The holder keeps the cheque and presents it only if something goes wrong.
Why they cause problems
The person who signed it often has no record of what was written on it, has forgotten it exists, or believed the underlying obligation was settled. It is then presented years later, sometimes for a figure the signatory never agreed.
If a security cheque has been presented against you
The fact that a cheque was given as security rather than as payment can be relevant, but it has to be established with evidence: the contract it was given under, the correspondence around it, and proof of what was actually owed at the moment it was presented. Assertion on its own does not do it.
If you are holding a security cheque
Check the instrument before you present it. A cheque completed incorrectly, or presented for the wrong amount, or presented after the underlying contract was settled, creates a problem for the holder rather than for the signatory.
What to do first
If you issued the cheque
Get the return slip and the reason for return. Work out the real balance owed, as opposed to the face value of the cheque. Approach the holder about a documented settlement. Find out whether anything has been filed against you, and where. Do not leave the country until you know whether a restriction has been entered.
If you are holding it
Keep the original cheque and the original return slip. Put the underlying agreement and any acknowledgement of the debt together in one file. Decide whether you want payment or a judgment, because a settlement agreed now is often worth more than an order obtained later against someone with nothing left. Then act, rather than waiting to see whether the money appears.

We then establish what the cheque was actually for, what remains owed, and which route is open. We tell you at that point whether the matter is worth pursuing or defending on the numbers involved, and we say so plainly if it is not.
Where you have issued the cheque, we deal with the holder, put a settlement structure in place where one is achievable, and respond to anything already filed. Questions people ask us
Is a bounced cheque still a criminal offence in the UAE?
Not in the way it was before the January 2022 reforms. The ordinary case of an account without sufficient funds is now dealt with mainly through enforcement and administrative consequences, while certain other acts connected with cheques are treated differently. Which category your matter falls into is the first thing to establish.
Can I go to prison for a dishonoured cheque?
This is the question we are asked most, and it is the one where old information does the most damage. The answer depends entirely on which category the matter falls into, and it is not a question to answer from a web page without seeing the file.
The cheque was a security cheque. Does that help me?
It can, but only with evidence of what it was given for and what was owed when it was presented.
Can I recover on a cheque if the signatory has left the UAE?
The file can still be opened and pursued. Recovery then depends on what assets or obligations remain here.
The amount written on the cheque is wrong. What can I do?
Raise it immediately and in writing, with the underlying contract and the payment record. A disputed amount is dealt with very differently from an admitted one, but only if it is actually disputed at the right time.
Should I pay something while I work out what to do?
A documented part payment against a stated balance is usually better than silence, provided it is recorded properly and is not treated as an admission of a figure you dispute. Get the wording right before you transfer anything.
