The short answer
This page covers both sides of the same work. Businesses chasing unpaid invoices usually call it debt recovery. Individuals chasing a personal loan, or a company chasing a consumer account, usually call it debt collection. The legal routes overlap, but the documents you need and the pressure points differ, so both are set out here.

Recovering a commercial debt
What the claim is built from
A commercial recovery is a documentation exercise before it is a legal one. The strength of the file comes from the contract or purchase order, the delivery notes or timesheets, the invoices, the statement of account, and any message in which the debtor accepted the balance. Where that trail is complete recovery is straightforward; where it is not, rebuilding it is the first job.
Deciding whether to pursue it
Before anything is filed we look at the debtor rather than the debt. Is the entity still trading? Is it the same one that signed? Is there an account, a licence or a property that can actually be reached? A judgment against a dormant company is an expensive piece of paper, and we say so before you spend on it.
Is the debt still in time
A claim has to be brought within the applicable period, and that period differs by the type of debt and the instrument it rests on. It is checked at the start.
Debt collection from individuals
Debt collection in Dubai from a consumer or an individual borrower is the same law approached differently. The sums are smaller, the paperwork is thinner, and the practical answer is more often a structured settlement than a judgment.
The rules collection activity works under
Recovery activity in the UAE is regulated, and conduct that amounts to harassment is not permitted however clear the debt is. Contacting an employer, threatening consequences that cannot lawfully follow, or disclosing the debt to third parties creates a problem for the creditor rather than the debtor.
When a payment plan is the better outcome
If a debtor has income but no capital, a properly drafted settlement agreement with a payment schedule usually recovers more than a judgment does. People often approach lawyers in Dubai for debt settlement on exactly this basis, from either side. It only works if it is documented in a form that can itself be enforced when the debtor defaults again.
The demand letter stage
What a legal demand does
A demand from a licensed advocate sets out the obligation, the amount, the basis of the claim and a deadline, and puts the debtor on notice that the next step is a filing. A significant share of debts are paid or settled here, because it is the first moment the debtor sees the matter is documented rather than a series of reminder emails.
What it should contain
The exact sum and how it is made up, the documents it rests on, any acknowledgement by the debtor, and the deadline. Vague demands invite a reply about reconciling accounts, which is how another two months disappear.
What makes a debt enforceable
A signed acknowledgement of debt
An acknowledgement in which the debtor confirms the amount and undertakes to pay is the most useful document a creditor can hold. It converts an argument about whether the money is owed into an argument about when it will be paid. If you can get one while relations are still workable, do.
Cheques
A cheque given for a debt is evidence of the obligation and may open a faster route than an ordinary claim. The treatment of a dishonoured cheque changed with reforms that took effect in January 2022, and much of the advice still circulating online describes the previous position. Guarantees and security
A personal guarantee from a shareholder, a corporate guarantee from a parent, or a bank guarantee changes who you can pursue. Whether it works depends on how it was signed, by whom, and whether the signatory had authority. We check the form before relying on it, because guarantees often fail on exactly that point.
Interest and late payment
Whether interest can be claimed, on what basis and from what date depends on the type of debt and on the contract. We state no rate here.
The court route
Which route the claim takes
Not every debt needs a full lawsuit. Where the debt is documented and undisputed there may be a shorter procedure; where it is contested it proceeds as an ordinary civil claim, and our civil litigation lawyers in Dubai page sets out those stages.
Court fees and translation
A court fee is payable on filing and is generally calculated against the value of the claim. Documents in another language have to go in as legal translations, because the proceedings are in Arabic. Both are real costs and both are budgeted before filing.
Freezing assets before judgment
A precautionary attachment can secure an account or an asset before or alongside the claim. It is the step that most changes a debtor’s willingness to settle, and it only reaches what is still there.
When the debtor disputes the debt
A debtor who raises a counterclaim about quality, delay or set off turns a recovery into a full dispute. That is not a reason to abandon it, but it changes the timetable and the cost, and it is usually the point at which a commercial settlement becomes the sensible outcome.
The execution court
A judgment is not money. It goes to the execution court, a separate stage with its own file, and that is where recovery actually happens. Creditors who stop at the judgment are the ones who never get paid.
What execution can reach
Execution measures can be directed at bank accounts, salary, vehicles, shares, receivables and property, depending on what can be identified. Identifying assets is the practical limit on recovery.
When the debtor genuinely cannot pay
A debtor with no assets and no income does not become solvent because a judgment exists. There are formal routes for companies and for individuals in financial difficulty, and where one applies it changes what a creditor can do and in what order.
Cross-border debts
The debtor is outside the UAE
If the debtor has left but has assets here, enforcement against those assets may still be possible. If both the debtor and the assets are abroad, the question becomes where to sue and whether a UAE judgment would be recognised there.
You are a creditor outside the UAE
We act for overseas suppliers and lenders owed money by UAE entities. What we need first is the contract, the invoices, proof of delivery, and the debtor’s exact registered name as it appears on its trade licence, because the name on an invoice is often not the name of the legal entity. What to gather before you instruct us
The contract or purchase orders and the terms attached. Every invoice and the statement of account. Delivery notes, signed receipts or timesheets showing the work was done. Any cheque and its return slip, any guarantee, and any written acknowledgement of the balance. The full correspondence in the order it happened. What is the difference between debt collection and debt recovery?
In practice they describe the same objective, and a debt collection lawyer in Dubai and a debt recovery lawyer are the same person. Recovery is the term used for business to business claims and formal legal action. Collection is used more often for consumer accounts and for the stage before a filing. What matters is not the label but whether the debt is documented and whether the debtor has anything to pay with.
How long does debt recovery in Dubai take?
A documented debt that settles after a demand can be resolved in weeks. A contested claim that runs to judgment and then to execution takes considerably longer, and an appeal adds to that. We give you a realistic range once we have seen the file.
Can I recover the debt without going to court?
Often. The demand stage, a negotiated settlement and a structured payment plan resolve a large share of matters. Court is the route when the debtor will not engage, or when there is a genuine dispute to be decided.
Can a debtor be stopped from leaving the UAE?
There are measures available to a judgment creditor at the execution stage, and whether one applies depends on the circumstances. We would rather explain what applies to your file than publish a general answer.
