What counts as a civil claim
Civil law in Dubai governs disputes between private parties, where what the claimant wants is money, the performance of something promised, or an order that the other side stop doing something. Criminal law is separate: it is brought by the state and it is about punishment, not compensation.
The claims we see most often
Unpaid invoices and loans. Breach of a supply, services or consultancy contract. Money paid for work never delivered or delivered badly. Disputes over a property sale or an off plan purchase. Construction defects and delay. Claims arising from an accident or from professional negligence. Arguments between former business partners about money taken out of a company.
Matters that look civil but go elsewhere
A rental dispute between landlord and tenant in Dubai goes to the Rental Dispute Centre, not the civil court. Most employment claims start with MOHRE. When the same facts are also a criminal matter
One set of facts can produce a civil claim and a criminal complaint at the same time, and the two files run separately. A criminal outcome does not produce payment, and a civil judgment does not close a criminal file.
Before you file anything
Is there anything to collect from
A judgment against a company with no assets and no traceable account is an expensive document. Before we advise on filing we look at who the defendant actually is, whether the entity that signed is the entity you dealt with, and whether there is anything realistic to enforce against.
Is the claim still in time
Civil claims are subject to limitation periods, and the period depends on the type of claim. This is checked first, because a claim brought out of time can fail without the merits ever being heard.
The demand letter
A properly drafted demand sets out the obligation, what was not done, what is claimed and by when. A meaningful share of civil matters settle here, because it is the first point at which the other side sees the claim is documented rather than asserted.
Whether settlement has to be attempted first
Some categories of civil dispute pass through an amicable settlement stage before reaching the court. Whether that applies depends on the type and value of the claim.
How a civil case is filed in Dubai
Registering the claim
The claim is registered with the Dubai Courts with a statement of case setting out the facts, the legal basis and the remedy sought, together with the supporting documents. The case is then given a number and a first hearing date.
Court fees
A court fee is payable on registration and is generally calculated by reference to the value of the claim. We give you the figure for your claim before filing rather than a rule of thumb.
Language and translation
Proceedings before the Dubai Courts are in Arabic and the file is in Arabic. Contracts, invoices and reports in another language generally have to go in as legal translations. Doing that at the start avoids adjournments later, and it is the cost people most often forget to budget for.
The stages of a case
The Court of First Instance
This is where the case is heard and decided. Hearings are short and are used to exchange written submissions, file documents and deal with procedural requests. The substance of a civil case here sits in the written memoranda rather than in oral argument, so the drafting is the work.
Appeal
A judgment at first instance can generally be appealed, and the appeal court can reconsider the facts as well as the law. Appeal periods are short and run from a defined date, not from the day you hear about the judgment.
Cassation
A decision of the appeal court may in defined circumstances go to the Court of Cassation, which reviews points of law rather than rehearing the evidence. Not every case qualifies.
Evidence and expert reports
What the court works from
Documents. Contracts, purchase orders, delivery notes, invoices, transfers, signed acknowledgements and the correspondence in which the other side accepted or disputed the position. Witness evidence carries less weight in civil practice here than people expect, so the file is built from paper.
When an expert is appointed
Where a case turns on accounts, engineering, valuation, handwriting or technical quality, the court will often appoint an expert to examine the material and report. In practice the report frequently decides the case.
Working with the expert
The expert sessions are where many civil cases are won or lost. Attending prepared, with the documents indexed and a clear written position, matters more than the eventual hearing. Expert fees are payable in addition to the court fee.
Securing the money before judgment
A precautionary attachment can freeze a bank account or an asset before or alongside the claim, so the defendant cannot move everything while the case runs. It is granted on conditions, it needs supporting evidence, and it only reaches assets that are still there.
Enforcing a judgment
The execution court
Winning does not produce payment. A judgment goes to the execution court, a separate stage with its own file, and that is where recovery actually happens. Claimants who stop at the judgment are the ones who never see the money.
What execution can reach
Execution can be directed at bank accounts, salary, vehicles, shares and property, depending on what can be identified. Identifying assets is the practical constraint, which is why the assessment at the start matters.
If the other side has left the UAE
A judgment can still be enforced against assets inside the country, and a foreign judgment may be enforceable here through the applicable route. Both directions depend on the country involved.
Where the claim is a straightforward debt
If what you are owed is a documented debt rather than a contested claim, there may be a shorter route than a full civil action. Our debt recovery and collection page sets out the options.
Time, cost and the alternatives
What makes a case longer
Translation, expert appointment, difficulty notifying the defendant, adjournments for documents, and an appeal by the losing side. Adjournments are normal and are not a sign that something has gone wrong.
What drives the cost
The value and complexity of the claim, whether an expert is needed, whether the other side defends properly, and whether it goes to appeal. Arbitration and settlement

Civil claims outside Dubai
Civil law in the UAE is largely federal, so a claim in another emirate is recognisable in shape. What differs is the court administration, local practice and where an advocate is registered to appear.
Questions people ask us
How do I choose a civil lawyer in Dubai?
Check that the practice is licensed and that the person handling your file is a registered advocate who can appear before the court hearing your case. Ask who does the drafting, ask for the basis of charging in writing, and ask for an honest view of the weaknesses in your claim. A lawyer who only tells you what you want to hear is not useful.
Do I need a lawyer for a small civil claim?
Not always, but the file is in Arabic and the written submissions decide the case, which makes acting for yourself harder here than people expect. A civil case lawyer in Dubai earns the fee mainly on the drafting, and for a documented claim the cost of doing it properly is usually lower than the cost of one that fails on procedure.
Can I bring a civil case if the other side has left the UAE?
Often yes. A case can proceed and a judgment can be obtained, and enforcement then depends on whether there are assets here or a route to enforce abroad. Tell us early if the defendant has gone, because it changes the approach.
Will the other side pay my legal costs if I win?
A successful party is generally awarded costs, but what a court awards towards legal fees is usually well below what the work costs. Plan on the basis that you carry your own fees.
How long does a civil case take in Dubai?
It varies with the complexity, whether an expert is appointed and whether there is an appeal. We would rather give you a range once we have seen the documents than a figure on a web page.
