The short answer
Injury claims in the UAE are decided on documents produced in the first days after the event, usually before anyone has spoken to a lawyer. The police report, the hospital notes and the insurer’s first letter set the shape of everything that follows. Road traffic accident claims
The police report decides most of the case
In the UAE the traffic police attend, investigate and record who was responsible. That report is the foundation of the claim, and courts and insurers both work from it. If it puts fault on you, or splits it in a way you disagree with, deal with that immediately through the process for challenging the finding, not once the claim has been valued against you.
Read the report as soon as it is issued, including the details that look administrative. A wrong vehicle, a wrong direction of travel or a wrong plate number is the sort of error that becomes expensive to correct later.
What the motor policy covers
Motor insurance is compulsory here, but the cover is not uniform. What a policy pays for injury, as opposed to vehicle damage, depends on the type of policy, who was injured, and whether an exclusion is engaged. A driver, a passenger and a pedestrian are not automatically in the same position. Before assuming you are covered, get the policy schedule and the full wording, not the certificate.
Who the claim is actually made against
People assume the claim is against the insurer. Sometimes it is, and sometimes it runs against the driver with the insurer standing behind it. The correct defendant affects where and how the case is filed, so it is settled before anything is submitted.
If you were partly at fault
A finding that you contributed to the accident is not the end of a claim. It affects it. What we look at is whether the apportionment in the report is supportable on the evidence, and if it is, what the claim is still worth.
Medical negligence claims
A bad outcome is not automatically negligence
This is the hardest part of the conversation and it is better to have it early. Medicine carries risk, and a poor result can follow treatment that was entirely competent. A claim needs a failure to meet the accepted standard of care, and a link between that failure and the harm you suffered. The job of medical negligence lawyers in Dubai is to tell you which side of that line your case sits on before you spend anything.
The committee stage
Medical liability complaints in the UAE do not begin in a courtroom. A complaint goes first to a specialist committee process run through the health authorities, where clinicians assess what happened. It means a medical negligence claim is not run the way an ordinary civil claim is run. We are deliberately not publishing the committee’s name, composition or procedure here, because that detail has to be confirmed against the current position rather than repeated from older articles.
Getting hold of your medical records
Your records are the case. Consent forms, operation notes, nursing observations, imaging, prescriptions, discharge summaries and the referral correspondence. Request the complete file in writing and keep proof of the request. If anything is missing, say so in writing at the time.
What the committee finding means for a court claim
The outcome matters a great deal to what follows, but it is not automatically the last word. Where the finding goes against you there may be a route to challenge it, and where it goes in your favour it is evidence rather than a cheque.
Workplace injury
An injury at work sits in two places at once. There is the entitlement that flows from the employment relationship, and there is the possibility of a separate civil claim where someone was at fault. Which routes are open depends on whether the employer insured and reported the incident properly, and on whether a third party was involved.
Report the injury to the employer in writing on the day, even if you are told it will be handled informally. An injury that was never recorded is the one that becomes difficult to prove.
Where a work injury overlaps a labour claim
Pursuing an employment entitlement and pursuing a civil claim are not the same process, and starting one can affect the other. Take advice before signing anything the employer or its insurer puts in front of you, particularly a document described as a settlement or a clearance. Insurance claims refused, underpaid or delayed
Why claims get refused
Most refusals cite one of a few reasons: a policy exclusion, non disclosure when the policy was taken out, late notification, a breach of a policy condition, or a dispute about causation. Each is arguable, and each is argued differently. The first step is getting the refusal in writing with the clause relied on, because a refusal that will not identify its own basis rarely survives being asked for one.
Reading the policy, not the brochure
The document that governs the claim is the full policy wording with its schedule and endorsements, not the summary you were sent when you bought it. Definitions matter more than headings. A claim refused under a definition of a term you assumed meant something ordinary is a common pattern, and often where the answer is.
Delay and underpayment
A claim that is neither accepted nor refused is its own problem, and so is an offer at a fraction of the loss. Both are handled the same way: a written chronology, a clear statement of the amount claimed and how it is calculated, and a deadline.
Challenging a refusal
There is an escalation route for a policyholder beyond the insurer’s own complaints department, and separately there is a civil claim. People looking at insurance law in Abu Dhabi and in Dubai are largely looking at the same federal framework, though the court that would hear a claim differs.
What compensation covers
In principle a claim addresses the harm the injury caused: treatment already paid for, ongoing care, earnings lost while unable to work, and the injury itself. How each is assessed in a UAE court is a matter for evidence, and we publish no figures, formulas or ranges. Anyone who quotes you a number before seeing the medical evidence is guessing.
Claims after a death
Where an accident causes a death, a separate form of compensation known as diya may arise alongside any insurance payment and any civil claim. Its basis, who receives it and how it interacts with the rest of the claim are matters we take instructions on.
Evidence to gather immediately
The police report and its reference number. Photographs of the vehicles, the scene and the road position before anything is moved, if it is safe to take them. Names and numbers for witnesses, who become impossible to find later. Every medical record from the first attendance onward. Receipts for treatment, medication and transport. A note of every day you were unable to work. The full policy wording. A dated note of what you were told and by whom.
Time limits
Injury, medical liability and insurance claims are all subject to time limits, and they are not the same period or measured from the same event. We publish no figure here, because the wrong one would do real harm. What is safe to say is that these periods are shorter than people assume, that continuing treatment does not necessarily hold the clock, and that the date to confirm is the first one in the file.
Accidents and claims outside Dubai
Much of the search for an accident case lawyer in Sharjah, or for help with an insurance claim in Abu Dhabi, comes from people dealing with the same federal rules that apply in Dubai. What differs is the police authority that produced the report and the court that would hear it.

Questions we are asked
The police report blames me. Is my claim over?
Not necessarily, but it is urgent. There is a process for disputing a traffic finding and it does not stay open indefinitely. Bring the report and any photographs or dashcam footage.
How do I know whether I have a medical negligence case?
By having the records reviewed. The distinction between a recognised complication and a failure of care is a clinical question before it is a legal one, and it cannot be answered from a description of the treatment.
The insurer says the policy excludes my claim. Can that be challenged?
Often. Exclusions are read against the wording, and insurers sometimes apply one that does not fit the facts. Send us the full policy and the refusal letter and we will tell you whether there is an argument.
How long does an injury claim take in Dubai?
A straightforward claim that settles takes a fraction of the time of one contested through a court with medical evidence and an appeal. We give a realistic range once we have seen the file.
Can I claim if I was a passenger?
A passenger is usually in a stronger position than a driver, because fault between the drivers does not turn on anything you did. The route the claim takes depends on the cover in place, which is why the policy comes first.
