UAE law separates the care of a child into two things that most foreign parents treat as one. Custody is the day to day care. Guardianship is the legal and financial authority. They can sit with different parents, and that split explains most of what surprises people later.

Custody and guardianship are two different things
This is the point to understand before anything else, because almost every practical problem parents run into here comes back to it.
What custody covers
Custody is physical care. Where the child lives, who feeds and clothes them, who supervises them, who takes them to school and to the doctor, who makes the ordinary decisions of an ordinary week. The parent who holds it is the custodian.
What guardianship covers
Guardianship in the UAE is legal and financial authority over the child. It commonly touches passports and official documents, school enrolment, certain medical authorisations, travel, and the handling of money or property belonging to the child.
Why the split surprises foreign parents
In many countries the parent the child lives with holds all the authority that goes with it. Here you can have your child with you full time and still need the guardian’s involvement to renew a passport or move the child to a new school. Parents who do not know this usually find out at a counter, in a hurry, with a deadline.
What it means week to week
Plan around it. Renewals, school moves, visas and travel all sit on the guardianship side. If the guardian will not cooperate, that is something a court can be asked to deal with, but it is far easier when the arrangement anticipates it from the start rather than leaving it to good will.

The welfare of the child comes first
Everything else is secondary to it. The court is working out what arrangement suits this child, at this age, in these circumstances.
The practical facts carry the weight
Stability of each home, who has actually been doing the caring, the child’s schooling and health, the capacity of each parent and the support around them, and how the parents behave towards each other and towards the child. Evidence of what has happened counts for more than statements about what each parent intends to do.
Conditions attached to holding custody
UAE law attaches conditions to being a custodian, and they can be raised against a parent during a case. They are not identical under the two frameworks and they have been amended. We check the current position against your own circumstances rather than quoting a rule at you.
Ages
There are ages in UAE law at which arrangements for a child can change. Those ages are widely misquoted online, they are not the same under the general regime as under the non-Muslim regime, and they have been amended. No age appears anywhere on this page for that reason. Anyone who gives you a number without asking which framework applies to you is repeating something they read.

Custody laws in the UAE for non-Muslim parents
Custody laws in the UAE do not apply one set of rules to every family, and this matters more for children than for any other part of a family case.
Two frameworks
There is a general personal status regime and a separate civil regime covering non-Muslims, and they approach arrangements for children differently. Shared arrangements
Expatriate parents usually arrive expecting something like joint custody, with the child’s time and the decisions divided between them. Whether that is the starting point depends on which framework applies.
An agreement between you is usually better than an imposed order
Where two parents can agree a workable arrangement, it is almost always better than one decided for them, because it can be specific about the things that cause friction later. Handover times, school holidays, who holds the passport, who signs what. Terms agreed at the family guidance and conciliation stage can be recorded rather than fought over.

Where one parent has care, the other normally has contact, and the detail is what makes it work.
A schedule that survives real life
A contact arrangement that ignores shift patterns, school runs and travel for work will break down within a term. It is worth spending time on the schedule at the point it is being drafted, including holidays, birthdays and what happens when someone is ill.
When contact is being obstructed
Cancelled handovers, a phone that stops being answered, a child who is never available on the agreed day. Keep a dated record of each occasion as it happens, because a contact arrangement that is not being honoured can be put before the court, and the record is what proves it.
Everyday information
Parents fall out over school reports, medical appointments and knowing where the child actually is. These things can be written into an arrangement, and doing so removes a whole category of argument.
Travel with a child and consent
This is a frequent source of urgent calls.
Consent to travel
Taking a child out of the UAE usually needs the agreement of the other parent, and where that parent is the guardian the authority sits with them. Get the consent in a form that will actually be accepted at the airport rather than relying on a message on your phone.
Passports
Disputes about who holds a child’s passport are common, and they are usually about control rather than about the document. Where the passport is being withheld to prevent contact or travel that has been agreed, that can be dealt with rather than tolerated.
If you fear the child will be taken
Where there is a real risk that the other parent will leave the country with your child, steps can be taken to prevent it. The value of those steps falls quickly with delay, so this is a same week matter, not something to raise at the next hearing.
Moving abroad with a child
Relocation is the hardest category of case a child custody lawyer in Dubai handles, because it cannot be split down the middle.
Ask first
A parent who wants to move abroad with a child, whether for a job, a new marriage or family support, should deal with it as an application rather than presenting it as a decision already taken. Moving first and asking afterwards damages a case badly and can create consequences for the parent who does it.
What a relocation case turns on
The realistic detail is what counts. Where the child would live and go to school, what care and support exists there, and what contact with the other parent would actually look like afterwards, in specific terms rather than as a promise.
If a child has already been taken
If your child has been removed from the UAE without your agreement, get advice immediately and bring everything you have, including messages, travel documents, flight details and any existing order.
When an order is ignored
A custody or contact order is not self-executing, and parents are often surprised that obtaining it was not the end of the matter.
The execution stage

Keep the record
Dates, times, messages, missed handovers. An enforcement application is built out of that record, and a record written at the time carries more weight than one assembled afterwards from memory.
Changing an arrangement that no longer fits
An order made when a child was small often stops working as the child grows, or when a parent moves, remarries or changes job. An existing order is not necessarily permanent and can be revisited.
What to bring to a first meeting
Birth certificates and passports for the children, both parents’ passports and Emirates ID, the marriage certificate, any existing court order or agreement, school and medical records, and a one page timeline of the separation and of the arrangements since. If any document was issued abroad, say so, because it will normally need legalisation and legal translation before it can be used.
Be clear about the outcome you want, not only the one you are trying to prevent. Parents often arrive knowing what they are afraid of and not what they are asking for, and the arrangement you could live with shapes the strategy from the first day.
Common questions about child custody in Dubai
At what age does custody change in the UAE?
There are ages at which arrangements can change, but they differ between the general regime and the non-Muslim regime and they have been amended. We will confirm the position that applies to your family rather than quoting a figure that may be out of date or from the wrong framework.
Does remarriage affect custody?
It can be raised, and conditions of that kind do exist. Whether it affects your position depends on which framework applies and on the facts, so get advice before assuming either way.
Can I take my child on holiday without the other parent?
Not safely on assumption. Check the custody and guardianship position, get consent in a form that will be accepted, and sort it out before booking rather than at the airport.
Can a father be the custodian?
Custody is decided on the child’s welfare and on the conditions the law attaches, and it is not fixed by which parent is asking. Fathers do bring and win custody applications.
Will a custody order from another country be recognised here?
It is not automatic. There is a process for putting a foreign judgment before the UAE courts, and whether it succeeds depends on the order and how it is proved.
